In primo luogo, secondo AGCM, la procedura (ad iniziativa di parte) prevista e regolamentata all\u2019art. 37 cod. nav. e all\u2019art. 18 reg. es. cod. nav. non assicurerebbe adeguate condizioni di pubblicit\u00e0 dell\u2019avvio, dello svolgimento e del completamento della procedura selettiva, prevedendo l\u2019insufficiente meccanismo c.d. del \u201crende noto\u201d e una pubblicit\u00e0 soltanto a livello locale. In secondo luogo, secondo AGCM, la procedura in contestazione non rispetterebbe i requisiti di imparzialit\u00e0 e di equidistanza in grado di evitare qualunque favoritismo ai concessionari storici. In altri termini, la procedura avvantaggerebbe i concessionari attuali: soltanto la previa indizione di una gara avviata mediante la pubblicazione di un vero e proprio bando che contenga e preveda i requisiti di partecipazione ed i criteri di valutazione delle offerte e di aggiudicazione sarebbe in grado, secondo AGCM, di assicurare i princ\u00ecpi di imparzialit\u00e0, massima partecipazione, non discriminazione, ecc.
